First. Legal Framework.

This Privacy Policy complies with the provisions of Law 81 of 2019.05.26 - Protection of Personal Data and DE-285 of 2021.05.28 - Regulation of Law 81 on the Protection of Personal Data and other complementary, amending and concordant rules.

Second. Responsible for the treatment

IDEATI S.A. is a company, based in Panama, that provides Information Technology services in several Latin American countries for public and private entities. IDEATI is responsible for the treatment of the personal data it collects in the development of its activities from its clients and the data of users in general, which it collects when they use its website. In accordance with the provisions of Law 81 of 2019.05.26 - Protection of personal data and DE 285 of 2021.05.28 Regulation of Law 81 of Protection of personal data, IDEATI has a record of the databases that are transferred to third parties, which will be available to ANTAI, in case it requires it.

IDEATI’s domicile is at HiTech Plaza, Office 5D, Obarrio, Panama City, Panama.

Third. Purpose and legitimacy of the treatment

The processing of IDEATI’s customers' personal data is intended to ensure the proper contractual relationship and to provide information on products and promotions as appropriate.

The processing of users' personal data collected through automated mechanisms when they use the digital media made available by IDEATI, aims to generate records of the number and frequency of visits and user activity, customize campaigns in social networks and perform the analysis and monitoring of the results of these actions, to provide better service and facilitate the use of digital media, for which purpose IDEATI uses cookies and similar technologies (collectively “cookies”).

The collection and processing of data in the use of digital media made available by IDEATI through the automated mechanisms mentioned above, in no case constitute operations that involve associating such information to any identified or identifiable user, nor IDEATI will use the information from networks or analysis service providers, with a purpose other than that strictly informed.

The processing of personal data provided by the user in forms and/or digital contracts and/or any other type of document or record of any nature suitable for such capture, is intended to manage the sending of information or other requests requested by the user, responding to their queries and/or requests and/or, to carry out activities necessary for the execution of a contractual relationship, as well as to obtain statistical data of the same.

In the case of identification and/or contact data provided by the user, IDEATI may also use them to send him/her commercial offers on its own products and services or those of third party collaborators not incompatible with those provided by IDEATI and information on marketing actions to be carried out (which may include campaigns, projects, sweepstakes, contests, events of any kind and subject matter), conducting satisfaction surveys and sending news (including by electronic or remote means).

The basis for legitimizing the processing of data for this purpose of communication is the informed consent of the user, which will be obtained at the time of data collection. The user may withdraw the consent for this purpose at any time through the means informed in this policy, without this implying any conditioning to the access to the services provided or marketed by IDEATI, nor to the use of the tools made available to users in general.

Fourth. Communication and international transfer of data

IDEATI will not make any transfer or communication to third parties of the personal data collected except for the legal exceptions provided for in Law 81 of 2019.05.26 - Protection of personal data and DE-285 of 2021.05.28 - Regulation of Law 81 of Protection of personal data and other complementary, amending and concordant rules or, when the achievement of the purpose pursued by the user so requires, or with your consent.

In order to achieve the purpose of personalizing campaigns in social networks, Facebook Ads and Instagram Ads are used in digital media, with which an audience can be created from data such as email addresses and/or telephone numbers, for which, it is necessary to share such data with Meta Platforms Inc. to, subsequently, create personalized audiences and target ads that IDEATI considers that may be of interest to the user. This provider operates under its own terms of service, which include appropriate security measures.

The services provided to IDEATI by the suppliers referred to in the preceding paragraphs may involve the hosting, even temporarily, of the data in each case indicated, on servers located outside the country, including in territories considered unsuitable by Panama for international data transfers, such as the United States of America. These international data transfers, which are necessary for the specific purposes informed, will only be carried out with the informed and unequivocal consent of the owner.

Consent for the informed international transfer of data for the purpose of providing personalized notices of our products through networks and sending communications by email, will be obtained at the time of collecting the data in each case in the form, contract or other document or record that corresponds, prior availability of adequate information to the user. In both cases, consent may be withdrawn by the user at any time by the means reported in this policy, the only consequence of withdrawing such consent being that, in the first case, you will stop viewing our personalized notices on networks and; in the second case, you will stop receiving our email communications.

Fifth. Use of instant messaging applications

IDEATI may offer communication channels with users through instant messaging applications such as WhatsApp and Telegram, in order to expedite the management of their requests, follow up or send commercial information, about launches or products and, in general, to establish a communication channel to receive and send messages of any nature, linked to the activity of IDEATI.

The data necessary for the use of these channels, will only be in the aforementioned WhatsApp/Telegram group managed by IDEATI, with the mobile number indicated as the data controller, who has adopted the necessary technical and organizational measures to ensure an adequate level of security for personal data.

Notwithstanding the foregoing, the user must consider that the companies providing these instant messaging applications operate under their own terms of service and use servers installed outside the country, even in territories considered unsuitable by Panama for international data transfers such as the United States of America, so it is advisable to carefully read their terms of use and privacy policies, as well as to set your preferences regarding the processing of data, which can be done from the applications themselves.

The use of these instant messaging applications with IDEATI will be completely optional for the user, since IDEATI will always provide alternative communication channels.

Duly informed of these extremes, by using these instant messaging applications with IDEATI, the user is declaring to know and accept the terms of this clause, and unequivocally consent to its use, including consent to the international transfer of data, which, if any, may be involved.

Sixth. Security Measures

IDEATI has adopted the necessary technical and organizational measures to guarantee the integrity, availability and confidentiality of the personal data in its databases, taking into account the state of technology, the nature of the data processed and the risks to which they are exposed, which are constantly being reviewed, updated and improved, in order to comply with the laws and regulations at the national level and the recommendations on best practices in Personal Data Protection.

Seventh. Rights of data owners

The owner of the data, upon proof of identity, may exercise the rights of access, rectification, cancellation and opposition (ARCO), in accordance with the provisions of Law 81 of 2019.05.26 - Protection of Personal Data and DE 285 of 2021.05.28 - Regulation of Law 81 of Protection of Personal Data, as amended and concordant before IDEATI via email to info@ideati.net or in person at its address at HiTech Plaza, Office 5D, Obarrio, Panama City, Panama.

In order to facilitate the exercise of the right of deletion of data related to the purpose of email marketing, all communications include an unsubscription note, the use of which will result in the immediate removal of the user’s personal data from the database for that purpose.

Eighth. Links and social networks

This Privacy Policy applies exclusively to data in IDEATI’s possession due to users' activity on the website. In no case does it extend to cases of access to them through external links, nor to links from the IDEATI website and the IDEATI application to other websites.

The user has the option to join the pages or groups that IDEATI has in different social networks, however, the data will belong to the corresponding Social Network, so IDEATI is not responsible for the processing of any personal data that the user discloses through these social network pages, being advisable that the user carefully read their conditions of use and privacy policies, as well as configure their preferences regarding the processing of data.

Ninth. Retention period

The data will be kept as long as they are necessary for the purposes for which they were collected in each case or until the user requests their deletion. When applicable, the data will be kept for the time necessary to comply with legal requirements.

Tenth. Updating of the Privacy Policy

IDEATI may review, revise, and/or permanently update all aspects related to its Privacy Policy. The moment it is updated, it will be informed through IDEATI’s website, as appropriate.

The use by the user of IDEATI’s website after these changes have been informed means the acceptance of the revised Privacy Policy.

Eleventh. Applicable Law and Jurisdiction

This Privacy Policy is governed in all its clauses and without exception by the laws of Panama.
